Facts
The athlete 2014040 appeals against the decision, dated December 12, 2014, of the Netherlands Institute for Sport Adjudication (Instituut voor Sportrechtspraak, ISR) which was brought forward by the Royal Dutch Athletics Association (Koninklijke Nederlandse Atletiek Unie, KNAU). In this case the athlete was sanctioned for a positive finding of a prohibited substance according the World Anti-Doping Agency (WADA) 2014 prohibited list.

History
The athlete had argued that the doping test was not valid because the sample container had been in a filthy environment and was unattended for one hour. Also he had claimed that the sample had not been divided in two, it was not kept cool for more than 15 hours. The athlete had claimed that the International Standard for Testing (IST) and the International Standard for Laboratories (ISL) had been violated.
The athlete demands that the sanction of the KNAU will be lifted till the verdict of this court will cancel the decision. The KNAU will allow the athlete to take part in national and international competition and training.
His demands are based on the fact that the doping test were inadequate and should not be permitted as proof.
The KNAU disagrees; the athlete did not mention which substances could have contaminated the sample container, he has not mentioned which third persons could have entered the doping control station. The athlete had claimed that the laboratory had not fulfilled the ISO-standards but this is not relevant: those rules are for being certificated as a laboratory and not for proof in a case.
The court concludes that the athlete has no hard evidence or circumstances to prove that deviations could have led to the positive finding.
The general interest of the KNAU weighs more than the interest of the athlete to qualify for the Olympics.

Decision
- The demands of the athlete are rejected.
- The costs for the legal procedures of the KNAU will be borne by the athlete.
