In December 2013 the Dutch Royal Strength Sport Fitness Federation (KNKF) has reported an anti doping rule violation against the Person after his sample tested positive for the prohibited substance metandienone. After notification a provisional suspension was ordered. The Persone filed a statement in his defence and was heard for the KNKF Disciplinary Committee.
The Person denied the intentional use of doping and argued that the supplements and medication he used for his cold might have been contaminated with the prohibited substance, or spiked by someone.

Without evidence the Committee concludes that the Person failed to prove how the prohibited substance entered his body. Therefore the KNKF Disciplinary Committee decides on 18 February 2014 to impose a 2 year period of ineligibility on the Person, starting on the date of the provisional suspension.
Fees and expenses for this Committee shall be borne by the Person.

NADO Flanders 2015 Disciplinary Commission 2015029 T

In March 2015 the National Anti-Doping Organisation Flanders (NADO Flanders) has reported an anti-doping rule violation against the Dutch kickboxer after his sample tested positive for the prohibited substance furosemide. After notification the Person filed a statement in his defence and he was heard for the NADO Flanders Disciplinary Commission.

The Person accepted the positive test result and stated that he used prescribed medication as treatment for his hypertension. However the Person’s doctor refused his cooperation in this case; the Person didn’t accept the Commission’s offer to consult another doctor for a statement; and his application for a TUE was dismissed.

The Commission finds that the Person failed to prove how the prohibited substance entered his body and concludes that he acted with negligence.
Therefore on 10 November 2015 the NADO Flanders Disciplinary Commission decides to impose a 2 year period of ineligibility on the Person starting on the date of the sample collection.
Fees and expenses for this Commission shall be borne partially by the Athlete.

ISR 2015 KNKF Decision Disciplinary Committee 2015028 T

In March 2015 the Royal Dutch Strength Sport and Fitness Federation (KNKF) has reported an anti doping rule violation against the Person after he refused to provide a sample for drug testing.
After notification the Person failed to attend the hearing of the ISR-KNKF Disciplinary Committee, nor did he file a statement in his defence.

The Doping Control Officer (DCO) reported that the Person was selected at the Powerlifting competition to provide a sample. The Person signed the Doping Control Form and received from the DCO permission to leave the Doping Control Station to drink after he could not produce a sample. Hereafter the Person failed to return to the Doping Control Station and left the competition. The DCO tried several times to contact the Person on his phone. The Person later submitted in a SMS message to the DCO that he refused to cooperate to the sample collection. The Person complained in his SMS about his unfair treatment due to that after unsuccessful participation in the powerlifting competition he was the athlete selected to provide a sample instead of all the other athletes.

Considering the evidence and the Person's refusal the ISR-KNKF Disciplinary Committee decides on 2 June 2015 to impose a 4 year period of ineligibility on the Person.

Fees and expenses for this Committee shall be borne by the Person.

After notification a provisional suspension was ordered. The Person failed to attend the hearing of the ISR-KNKF Disciplinary Committee, nor did he file a statement in his defence.
Without the Person’s response the ISR-KNKF Disciplinary Committee decides on 2 February 2015 to impose a 2 year period of ineligibility on the Person starting on the date of the provisional suspension, i.e. on 21 November 2014.
Fees and expenses for this Committee shall be borne by the Person.

On 27 October 2015 the NADO Flanders Disciplinary Commission decided to impose a 4 year period of ineligibility on the minor Dutch cyclist after his A and B samples tested positive for the prohibited substances amphetamine, 19-norandrosterone and 19-noretiocholanolone (metabolites of nandrolone).

Hereafter in November 2015 the Athlete appealed the decision of 27 October 2015 with the NADO Flanders Disciplinary Council.
The Athlete admitted the violation and stated that in November and December 2014 his father as his coach administered him injections with the prohibited substance and gave him supplements.

The Council accepts the Athlete’s explanation how the prohibited substances entered his body and considers that he acted with no significant fault or negligence because at the time of the violation he was trusting as a minor his father as his coach.
With the Athletes explanation and the circumstances in this case the Council concludes that there are grounds to reduce the imposed sanction.
Therefore on 22 January 2016 the Disciplinary Council decides to impose a 2 year period of ineligibility on the Athlete, starting on the date of the notification, i.e. on 15 September 2015.
Fees and expenses for this Council shall be borne partially by the Athlete.

25 November 2015 the Disciplinary Committee of the Royal Dutch Soccer Association (Koninklijke Nederlandse Voetbalbond, KNVB) decided to impose a two year period of ineligibility on the Person after his sample tested positive for the prohibited substance cannabis with a high concentration (573 ng/ml) above the WADA threshold. After notification of the violation the Person failed to attend the hearing of the KNVB Disciplinary Committee, nor did he file a statement in his defence.

Hereafter in December 2015 the Person appealed the decision of 25 November 2015 with the KNVB Appeal Committee.
The Person requested for a reduced sanction and he was heard for the Appeal Committee.
The Person argued that he didn’t know that cannabis is a prohibited substance; his use of cannabis was out of competition; and without intention to enhance his performance. He stated that he smoked cannabis at least for one year during the weekends and frequently also on a weekdays. He said that he used out of competition 5 joints with friends in the weekend, 6 days before he provided a sample for drug testing.

The Appeal Committee accepts the Persons explanation and concludes that he is a chronic cannabis user acting with negligence in his responsibility that no prohibited substance enters his body.
Considering the circumstances the KNVB Appeal Committee decides on 26 February 2016 under the Rules to partially accept the Person’s appeal; to reduce the previous imposed sanction; and instead to impose a 9 month period of ineligibility on the Person starting on 25 November 2015.

In July 2015 the Royal Dutch Soccer Association (Koninklijke Nederlandse Voetbalbond, KNVB) has reported an anti-doping rule violation against the Person after his sample tested positive for the prohibited substance furosemide.

After notification the Person filed a statement in his defence and waived his right to be heard for the KNVB Disciplinary Committee.
The Person submitted that in the summer he managed to reduce his weight in order to receive a new contract from his club. To keep his weight he used over the counter supplements and thinks that one of these supplement is contaminated with the prohibited substance. The Person stated that he had no intention to enhance his performance and he initiated analysis of the supplements he used. However afterwards the Person reported that he cancelled the analysis of his supplements by a WADA certified laboratorium for financial reasons.

Considering the evidence the Committee concludes that the Person failed to proof how the prohibited substance entered his body and without grounds to reduce the sanction.
Therefore the Disciplinary Committee decides on 28 December 2015 to impose a 2 year period of ineligibility on the Person starting on the date of the decision.

On 6 August 2015 the ISR-KNBB Disciplinary Committee of the Royal Dutch Billiards Federation (Koninklijke Nederlandse Biljartbond, KNBB), decided to impose a 18 month period of ineligibility on the Person after his sample tested positive for the prohibited substance metoprolol due to he used prescribed medication without a TUE.

Hereafter in September 2015 the Person appealed the decision of 6 August 2015 with the ISR-KNBB Appeal Committee.
Considering the Person's negligence the ISR-KNBB Appeal Committee concludes that there are no grounds to reduce the imposed sanction and decides on 24 December 2015 to uphold the decision of 6 August of the KNBB Disciplinary Committee.

The Person submitted that he used prescribed medication; he took a pill for his hypertension the day before he provided a sample for drug testing; he mentioned the use of the medication on the Doping Control Form; he didn’t know that his medication contained a prohibited substance; and he wasn’t aware he needed a TUE.

The Committee accepts the Person’s explanation how the prohibited substance entered his body and concludes that he acted with considerable negligence and without intention to enhance his performance.
Therefore the ISR-KNBB Disciplinary Committee decides on 6 August 2015 to impose a 18 month period of ineligibility on the Person starting on the date of the decision.
Fees and expenses for this Committee shall be borne by the Person.
